These Terms of Service ("Terms") govern your access to and use of the Major Tracker service operated by Major Phones LLC ("Company," "we," "us," or "our"), a limited liability company registered in the State of Wyoming, United States. By accessing or using our service at majortracker.com (the "Service"), you agree to be bound by these Terms.
Please read these Terms carefully before using our Service. If you do not agree with any part of these Terms, you may not access or use the Service.
1. Description of Service
Major Tracker is a search engine optimization (SEO) rank tracking service that allows users to:
- Monitor website keyword positions on Google search results
- Track position changes over time (daily or weekly updates)
- View historical ranking data for up to 30 days
- Access automated KPIs and analytics reports
- Manage multiple projects with individual keyword sets
- View search volume, keyword difficulty, and CPC metrics
2. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old to create an account and use the Service. By creating an account, you represent that you are at least 18 years of age.
3. Service Plans and Pricing
3.1 Pricing Model
Major Tracker operates on a usage-based pricing model. Pricing is determined by:
- The number of keywords you track (ranging from 50 to 6,000 keywords)
- The update frequency you select (daily or weekly)
Current pricing is displayed on our website and may be updated from time to time. Any price changes will be communicated in advance.
3.2 Payment Terms
- All fees are charged in US Dollars (USD)
- Payments are processed through secure third-party payment providers
- You authorize us to charge your selected payment method for all applicable fees
- Refunds are governed by our Refund Policy (see Section 4)
3.3 Balance System
Major Tracker uses a prepaid balance system. You must maintain sufficient balance in your account to create and maintain projects. If your balance is insufficient, project creation may be restricted.
4. Refund Policy
This Refund Policy constitutes a binding agreement between you ("User," "Customer," or "you") and Major Phones LLC ("Company," "we," "us," or "our"). Payments for the Service are processed by Paddle.com Market Limited ("Paddle"), our authorized payment provider. By making any payment toward the Service, you acknowledge that you have read, understood, and agree to be bound by this Policy.
4.1 Consumer Right to Cancel (14-Day Period)
If you are a Consumer (as defined under applicable consumer protection laws), you have the right to cancel your purchase within 14 days without giving any reason, unless an exception applies.
- Cancellation Period: The cancellation period will expire 14 days after the day following the completion of your transaction.
- How to Cancel: To exercise your right to cancel, you must inform us of your decision by contacting support at support@majortracker.com before the 14-day period expires.
- Subscription Services: Your right to cancel applies only to the initial subscription purchase and not upon each automatic renewal.
Effect of Cancellation
If you cancel your purchase as permitted above:
- We will reimburse all payments received from you without undue delay.
- Reimbursement will be made no later than 14 days after we are informed of your decision to cancel.
- We will use the same payment method you used for the initial transaction, and you will not incur any fees as a result of the reimbursement.
Exception to the Right to Cancel
Important: Your right as a Consumer to cancel does not apply to the supply of Digital Content that you have started to download, stream, or otherwise access, and to Products which you have already benefited from. By using Major Tracker's services (such as creating projects, tracking keywords, or accessing ranking data), you acknowledge that you have begun using the digital service and waive your right to cancel.
4.2 General Refund Policy
Outside of the Consumer Right to Cancel described above, refunds are provided at our sole discretion and on a case-by-case basis. Refund requests may be refused.
- Discretionary Refunds: We may, at our sole discretion, issue full or partial refunds in exceptional circumstances.
- Refund Denial: We will refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behavior.
- Consumer Rights: This policy does not affect your statutory rights as a Consumer in relation to Products which are not as described, faulty, or not fit for purpose.
4.3 Eligibility Requirements
To be considered for a refund, the following conditions should generally be met:
- The refund request must be submitted in writing via email to support@majortracker.com.
- The account remains in good standing without any violations of the Acceptable Use Policy (Section 5).
- There is no evidence of fraudulent activity, abuse of the refund policy, or bad faith conduct.
- The User has not previously abused refund policies for prior accounts.
4.4 Exclusions and Non-Refundable Transactions
The following transactions and circumstances are expressly excluded from refund eligibility:
- Digital Content Already Accessed: Services where you have begun using the digital content (creating projects, tracking keywords, viewing reports).
- Policy Violations: Accounts suspended or terminated for violations of our Terms of Service or Acceptable Use Policy.
- Fraudulent Activity: Transactions associated with suspected fraud, unauthorized use, or identity misrepresentation.
- Promotional Credits: Bonus credits, promotional balances, or credits issued as compensation are non-refundable.
- Subscription Renewals: Automatic renewal charges after the initial purchase period (you must cancel before renewal).
4.5 Refund Request Procedure
To initiate a refund request, please follow these steps:
- Step 1: Send an email to support@majortracker.com with the subject line "Refund Request - [Your Account Email]".
- Step 2: Include in the email body: (a) your registered email address, (b) the date and amount of the transaction, (c) the payment method used, and (d) a brief explanation for the refund request.
- Step 3: Our support team will acknowledge receipt within one (1) business day and review your request within three (3) business days.
- Step 4: Upon approval, refunds will be processed to the original payment method within fourteen (14) days, subject to the processing times of your financial institution.
4.6 Chargebacks and Disputes
Important Notice: If you initiate a chargeback or payment dispute with your bank or payment provider without first contacting us to resolve the issue, we reserve the right to: (a) immediately suspend your account and all associated services, (b) pursue collection of the disputed amount plus any applicable fees, and (c) report the incident to fraud prevention databases. We strongly encourage you to contact our support team before initiating any dispute with your payment provider.
4.7 Indirect Sales Tax Refund
If you have been charged sales tax (VAT, GST, Consumption Tax, or similar) on your purchase and are registered for sales tax in the country of purchase, you may be entitled to a refund of the sales tax amount if permitted by applicable laws:
- You must contact us within 60 days after completing the purchase to be eligible.
- A valid sales tax registration code for your country must be provided.
- Requests received after 60 days from the transaction date will not be processed.
4.8 Exceptional Circumstances
Notwithstanding the above provisions, Major Phones LLC reserves the sole and absolute discretion to issue full or partial refunds in exceptional circumstances, including but not limited to:
- Extended service outages lasting more than 72 consecutive hours due to causes within our control.
- Material misrepresentation of Service features on our website at the time of purchase.
- Technical errors resulting in duplicate charges or incorrect billing amounts.
- Legal or regulatory requirements mandating refunds in specific circumstances.
Any refunds granted under this section are made at our sole discretion and shall not establish precedent or create any future obligation to issue similar refunds.

5. Acceptable Use Policy
You agree NOT to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Track keywords for websites you do not own or have authorization to monitor
- Interfere with or disrupt the Service or servers connected to the Service
- Attempt to gain unauthorized access to any part of the Service
- Use automated scripts, bots, or scrapers to access the Service
- Reproduce, duplicate, copy, sell, or resell the Service without authorization
- Circumvent any usage limits or restrictions placed on your account
- Transmit any viruses, malware, or other malicious code
6. Data Accuracy and Limitations
While we strive to provide accurate ranking data:
- Search engine rankings can fluctuate frequently and vary by location, device, and user
- We rely on third-party data providers for ranking information
- We do not guarantee 100% accuracy of position data at all times
- Metrics such as search volume, difficulty, and CPC are estimates based on available data
- Historical data is retained for 30 days and may be deleted after that period
The Service is provided for informational purposes. You should not make business decisions based solely on data from Major Tracker without independent verification.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Major Phones LLC and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any data you input into the Service (such as keywords and website URLs). By using the Service, you grant us a license to use this data solely for the purpose of providing the Service to you.
8. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Non-payment of applicable fees
- Extended periods of inactivity
- Any other reason at our sole discretion
You may cancel your account at any time by contacting us or using the account settings. Upon termination, your right to use the Service will immediately cease.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAJOR PHONES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Major Phones LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
12. Modifications to Service and Terms
We reserve the right to:
- Modify, suspend, or discontinue any part of the Service at any time
- Update these Terms at our discretion
- Change pricing and features with reasonable notice
We will notify you of any material changes to these Terms by posting the new Terms on this page and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming. You agree to submit to the personal jurisdiction of such courts.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Major Phones LLC regarding your use of the Service.
